VOO LLC respects the privacy of its users. With that respect in mind this we want to help you under our privacy practices. This Privacy Policy explains how we collect, use, disclose, and safeguard your information and/or “data” when you use our mobile application. We recommend that you please read our Privacy Policy carefully as it highlights all the key information you will need to know about our privacy practices. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE APPLICATION. BY ACCESSING VOO, LLC APPLICATION YOU ACKNOWLEDGE CONSENT AND AGREEMENT TO THIS PRIVACY POLICY.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Application after the date such revised Privacy Policy is posted.

This Privacy Policy does not apply any third-party application store from which you may have installed this Application, which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.

SCOPE OF THIS POLICY
This notice describes how VOO LLC and its affiliates collect and use data. This notice applies to any and all VOO LLC users globally, notwithstanding the use of a service covered by a separate privacy notice. This notice specifically applies to:

  • Application Customers:
    Individuals who request or receive transport, delivery, and/or any other related services via their VOO LLC account such as driver pickup and drop off, requesting or receiving of foods or other products and services for delivery or pick-up via their VOO LLC account, and individuals using guests checkout features to access delivery or pick-up services without creating and/or logging in to their account.
     
  • Application Drivers:
    Individuals who provide transport or delivery services via VOO LLC or any of its subsidiaries.
     
  • Guest Users:
    Individuals who receive trip and delivery services ordered by other VOO LLC account owners, including those who receive services arranged by VOO LLC Affiliate or Entity’s customers (collectively, “Enterprise Customers”), or by friends, family members or other individual account owners.

This document also serves as VOO LLC’s notice regarding other collections of data in connection with its services. For example, we may collect the contact information of owners or employees of restaurants or other merchants on the VOO LLC Eats, platforms; the contact information of individuals that manage and use accounts owned by Enterprise Customers; or data of individuals who start but do not complete their applications to be drivers or delivery persons. Individuals identified as being subject to this notice are referred to as “users”.

The provisions of this notice are subject to applicable laws in the locations in which we operate, and thus any practices described herein are only applicable in whole or in part in so much as they are permitted by those laws and regulations of the particular country or region. In addition, please note the following:

DATA CONTROLLER AND TRANSFER

VOO LLC Inc. is the data controller for the data collected in connection with use of VOO LLC’s services. VOO LLC operates, and processes personal data for travel and delivery. In order to fulfil our agreements with all our users, or based on users’ instructions or prior consent we transfer data to any partnered data controller when necessary to assist our users. We also to respond to a request for personal data from any law enforcement agencies. VOO LLC only divulges personal data to law enforcement agencies in a manner that is consistent with the regulatory requirements of applicable laws.

To ensure quality data protection for its users, VOO LLC has implemented training for personnel responsible for managing personal data as well as policies and procedures limiting the access and processing of personal data. VOO LLC ‘s policy regarding government data access prevents the sharing of personal data to government entities, except when disclosure is mandated by applicable laws, or there is imminent risk of serious harm to individuals or consent is obtained.

VOO LLC’s applications uses encryption of data to help protect users’ full identity against unauthorized disclosure as protection while it is in transit between VOO LLC apps and our servers, and when the data is processed on our servers.

 

COLLECTION OF YOUR INFORMATION

VOO LLC may collect information from our users in a variety of ways such as details provided during account creation or during use of our services, such as location, app usage and device data. VOO LLC collects background check information for its drivers, delivery personnel, and vendors.: This includes information submitted during the application process, such as driving history or criminal record (where permitted by law), license status, known aliases and prior addresses, and right to work. This information may be collected by an authorized vendor on VOO LLC’s behalf. We use identity verification
 

photos includes photos of users (such as selfies) and/or their government-issued identifications. These photos may be used to verify a user’s identity, such as through facial verification technologies.

VOO LLC also collects data from other from other sources, including but not limited to other users or account owners, business partners, vendors, insurance and financial solution providers and governmental authorities. The information we may collect via the Application depends on the content and materials you use, and includes:

Personal Data From User Profiles

This data can include demographic and other personally identifiable information including but not limited to a user’s name, email, phone number, login information, address, profile picture, payment or banking information (including related payment verification information), driving license and/or any other such government-issued documents or identification (such as passports which may include identification numbers as well as date of birth, gender and photo). This also includes vehicle or insurance information of drivers and delivery persons, emergency contact information, user settings and evidence of health or fitness to provide services using our application. This information is collected voluntarily from our users when creating or updating their accounts, or place orders. If you choose to share data about yourself via your profile, online chat, or other interactive areas of the Application, please be advised that all data you disclose in these areas is public and your data will be accessible to anyone who accesses the Application.

Derivative Data

Information our servers automatically collect when you access the Application, such as your native actions that are integral to the Application, including liking, re-blogging, or replying to a post, as well as other interactions with the Application and other users via server log files.

Financial Data:

We collect transactional and financial information related to the use of our services, including the type of services provided or requested; details for any order or trip (such as date and time, requested pick-up and drop-off addresses, distance travelled and items ordered); and information in relation to a payment transaction (such as vendor’s or merchant's name and location, amount charged and payment method). We also associate a user’s name with that of anyone who uses their promotion code.

 

Data from Social Networks:

User information from social networking sites, such as [Facebook, Instagram, Tik Tok, Twitter], including your name, your social network username, location, gender, birth date, email address, profile picture, and public data for contacts, if you connect your account to such social networks. This information may also include the contact information of anyone you invite to use and/or join the Application.
 

Geo-Location Information:

We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using the Application, to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings.

 

Mobile Device Access

We may request access or permission to certain features from your mobile device, including your mobile device’s storage. If you wish to change our access or permissions, you may do so in your device’s settings.

Mobile Device Data:

Data may be collected from your device such as your device ID number, model, and manufacturer, version of your operating system, phone number, country, location, and any other data you choose to provide.

 

Push Notifications

We may send you push notifications regarding your account or the Application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.

Third-Party Data:

Information from third parties, such as personal information or network friends, if you connect your account to the third party and grant the Application permission to access this information.

Data From Contests, Giveaways, and Surveys:

Personal and other information you may provide when entering contests or giveaways and/or responding to surveys.

 

USE OF YOUR INFORMATION

VOO LLC reserves the right to use the data collected to improve its users experience. VOO LLC will not sell or share user data with third parties for purposes of their direct marketing, except with users’ consent. Information collected via the Application may be used for the following:

  • Create and manage your account
  • Use proximity location data to enable delivery, transport and services such as calculating ETA, tracking driver or delivery personnel progress, and matching available drivers/delivery personnel based on availability.
     
  • Enable dynamic pricing for trips and deliveries and process payments for said pricing.
  • Adjust user settings and preferences based on past activities for a more personalized user experience.
  • Perform operations necessary for maintaining our services, such as troubleshooting software bugs and providing users with trip or delivery updates, generate receipts and information regarding changes to our terms, services or policies.
  • Monitor and facilitate insurance, vehicle, invoicing or financing solutions.
  • Compile anonymous statistical data and analysis for use internally.
  • Email you regarding your account or order.
  • Enable user-to-driver/delivery personnel communications.
  • Providing security and safety to our users such as the use of identity, eligibility, background, and performance checks to protect our users from any unsafe or ineligible drivers.
  • Analyze drivers’ or delivery personnel’s devices to detect unsafe driving behavior such as speeding or harsh braking and acceleration, and to inform them of safer driving practices. We also use data from delivery personnel’s devices to verify the type of vehicles they used to provide deliveries.
  • Combat any types of fraud, including fraudulent accounts, fraudulent uses of our services, unauthorized driving or deliveries, unauthorized payments that may be connected to a user’s identity, unauthorized use of another user’s account.
  • Use of reviews, ratings, and any other such feedback to improve user experience.
  • Sharing a user’s name, location, phone number, vehicle details and other relevant information with third-party companies that support the management and de-escalation of interpersonal conflicts that may occur between users while on a trip or in the process of making a delivery.
  • Provide customer support, including investigating and addressing user concerns and to monitor and improve our customer support responses and processes.
  • Test, research, analyze, data for product development and machine learning to improve the user experience such as developing new services and features.
  • Increase the efficiency and operation of the Application.
  • Request feedback and contact you about your use of the Application.
  • For marketing and advertising such as emails, text messages, push notifications and in-app messages or other communications.
  • Non-marketing communications such as alerts, surveys, and rate promotion.
  • Resolve disputes and troubleshoot problems.
  • Processing partial or full refunds.
  • Investigate or address claims or disputes relating to use of VOO LLC’s services, to satisfy requirements under applicable laws, regulations, or operating licenses
     

or agreements, or pursuant to legal process or governmental request, including from law enforcement.

  • Send you a newsletter.
  • Solicit support for the Application.
  • Fulfill and manage purchases, orders, payments, and other transactions related to the Application.
  • Generate a personal profile about you to make future visits to the Application more personalized.
  • Monitor and analyze usage and trends to improve your experience with the Application.

 

DISCLOSURE OF YOUR INFORMATION

VOO LLC reserves the right to share data with our affiliates, subsidiaries and partners, for legal reasons or in connection with claims or disputes. We also maintain the right to share information with other users or at a user’s request. The reasons for which your information may be disclosed is as follows:

By Law or to Protect Rights:

If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation. This includes exchanging information with other entities for fraud protection and credit risk reduction.

Third-Party Service Providers:

We may share your information with third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance.

Marketing Communications:

With your consent, or with an opportunity for you to withdraw consent, we may share your information with third parties for marketing purposes, as permitted by law.

Interactions with Other Users:

If you interact with other users of the Application, those users may see your name, profile photo, and descriptions of your activity, including sending invitations to other users, chatting with other users, liking posts, following blogs.

Online Postings:
 

When you post comments, contributions or other content to the Applications, your posts may be viewed by all users and may be publicly distributed outside the Application in perpetuity

 

Third-Party Advertisers:

We may use third-party advertising companies to serve ads when you visit the Application. These companies may use information about your visits to the Application and other websites that are contained in web cookies in order to provide advertisements about goods and services of interest to you.

Affiliates:

We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.

 

Business Partners:

We may share your information with our business partners to offer you certain products, services or promotions.

Social Media Contacts:

If you connect to the Application through a social network, your contacts on the social network will see your name, profile photo, and descriptions of your activity.

Other Third Parties:

We may share your information with advertisers and investors for the purpose of conducting general business analysis. We may also share your information with such third parties for marketing purposes, as permitted by law.

Sale or Bankruptcy:

If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity. If we go out of business or enter bankruptcy, your information would be an asset transferred or acquired by a third party. You acknowledge that such transfers may occur and that the transferee may decline honor commitments we made in this Privacy Policy.

Types of Data Shared:

VOO LLC reserves the right to share with other users the following types of data for the operation and experience of its users:
 

  • Customer’s first name, rating, and pick-up and/or drop-off locations with drivers for rides or delivery.
  • Customers’ first name with other customers in a car sharing trip as well as the drop-off location of the other customers.
  • Order recipients’ first name, delivery address and order information with the restaurant or merchant and, for order deliveries, with the delivery person. We may also share ratings and feedback, or other information to the extent required by law, with the restaurant or merchant and, for order deliveries, the delivery person.
  • For drivers and delivery persons, we may share data with the rider(s), order recipient(s) and restaurants or merchants, including name and photo; vehicle make, model, colour, number plate and vehicle photo; location (before and during trip); average rating provided by users; total number of trips; period of time since they signed up to be a driver or delivery person; contact information; and driver or delivery person profile, including compliments and other feedback submitted by past users.
  • Service recipients are provided with receipts containing information such as a breakdown of amounts charged, driver or delivery person’s first name, photo and route map. We also include other information on those receipts if required by law.
  • Other people at the user’s request. For example, we share a user’s ETA and location with a friend when requested by that user, or a user’s trip information when they split a fare with a friend.
  • VOO LLC business partners. For example, if a user requests a service through a partnership or promotional offering made by a third party, VOO LLC may share certain data with those third parties. This may include, for example, other services, platforms, apps or websites that integrate with our APIs; vehicle suppliers or services; those with an API or service with which we integrate; or restaurants, merchants or other VOO LLC business partners and their users in connection with promotions, contests or specialized services.
  • Data requested by our subsidiaries and affiliates to help us provide our services or conduct data processing on our behalf.
  • Emergency services: We offer features that enable users to share their data with police, fire and ambulance services in the event of an emergency or after certain incidents. For more information, please see the sections below titled “Choice and Transparency” and “Emergency Data Sharing”.
  • Questions or comments from users submitted through public forums such as our blogs and/or respective social media pages may be viewable by the public, including any data included in the questions or comments submitted by a user.
  • Data requested by payment processors and facilitators, background check and identity verification providers, cloud storage providers, social media companies, marketing partners and marketing platform providers, advertising intermediaries, research partners, vendors, Google, in connection with the use of Google Maps in VOO LLC’s apps, consultants, lawyers, accountants and other professional service providers
  • Data other than as described in this notice if we notify the user and they consent to the sharing
     
  • Data requested by law enforcement officials, public health officials, other government authorities, airports, or other third parties as necessary to enforce our Terms of Service, user agreements or other policies, if we believe it’s required by applicable law, regulation, operating license or agreement, legal process or governmental request, or where the disclosure is otherwise appropriate due to safety or similar concerns.

 

Please note that VOO LLC hold no responsibility for the actions of third parties with whom you share personal or sensitive data, and we have no authority to manage or control third-party solicitations. If you no longer wish to receive correspondence, emails or other communications from third parties, you are responsible for contacting the third party directly.

 

TRACKING TECHNOLOGIES

Cookies and Web Beacons :

We may use cookies, web beacons, tracking pixels, and other tracking technologies on the Application to help customize the Application and improve your experience. When you access the Application, your personal information is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the Application. You may not decline web beacons. However, they can be rendered ineffective by declining all cookies or by modifying your web browser’s settings to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis.

Internet-Based Advertising : Applicability TBD for VOO LLC apps. Additionally, we may use third-party software to serve ads on the Application, implement email marketing campaigns, and manage other interactive marketing initiatives. This third-party software may use cookies or similar tracking

Application Analytics :

THIRD-PARTY WEBSITES

The Application may contain links to third-party websites and applications of interest, such as partnered vendors for delivery. Once you have used these links to leave the Application, any information you provide to these third parties is not covered by this Privacy Policy, and we cannot guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from the Application.

SECURITY OF YOUR INFORMATION

VOO LLC takes the security of its users as the highest priority and applies robust security measures to insure data protection and the safety of your personal information. Unfortunately, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse, but we have taken every step to secure the personal information you provide to us. That being said please bear in mind that any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.

 

CONTROLS FOR DO-NOT-TRACK FEATURES :

Most web browsers and some mobile operating systems [and our mobile applications] include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

OPTIONS REGARDING YOUR INFORMATION

 

You may at any time review or change the information in your account or terminate your account by:

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

If you no longer wish to receive correspondence, emails, or other communications from us, you may opt-out by:

  • Noting your preferences at the time you register your account with the Application
  • Logging into your account settings and updating your preferences.

If you no longer wish to receive correspondence, emails, or other communications from third parties, you are responsible for contacting the third party directly.

Data Retention and Deletion

VOO LLC maintains the right to retain user data for as long as necessary for the purposes of legal compliance and operational effectiveness. The period of time for which we retain user data is determined by the type of data, the category of user to whom the data relates to, legal and regulatory requirements, purposes of safety, security and fraud prevention, or by issues relating to the user’s account such as an outstanding credit or an unresolved claim or dispute. While a user may request deletion of their accounts at any time, we may continue to retain that user’s data after a deletion request due to legal or regulatory requirements or for reasons stated in this policy.

Device permissions

Most mobile device platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without the device owner’s permission, and these platforms have different methods for how that permission can be obtained. Please check the available settings on your device or check with your provider.

In-app ratings pages

After every trip, drivers and riders are able to rate each other on a scale from 1 to 5. An average of those ratings is associated with a user’s account and is displayed to other users for whom they provide or receive services. For example, rider ratings are available to drivers from whom they request transport, and driver ratings are available to their riders.

This 2-way system holds everyone accountable for their behavior. Accountability helps create a respectful, safe environment for drivers and riders.

Riders can see their average rating in the main menu of the VOO LLC app, and also access a breakdown of their average rating in VOO LLC’s Privacy Centre.
 

Drivers can see their average rating after tapping their profile photo in the VOO LLC Driver app.

Delivery persons may also be rated by order recipients, restaurants and merchants.

Marketing and advertising choices

VOO LLC provides users with the following choices regarding how their data is used for purposes of marketing and advertising:

  • Personalized marketing communications from VOO LLC: Users may choose here whether to receive communications (such as emails, push notifications and in-app messages) about VOO LLC products and services that are personalized based on their data to make it more relevant to them. Users may also choose here whether to receive any marketing emails from VOO LLC.
  • VOO LLC ads: Users may choose here whether their data is used and shared with advertising partners to deliver personalized ads about VOO LLC products and services on third-party apps and websites, or to measure the effectiveness of such ads.
  • Restaurant and merchant ads: Users may choose here whether VOO LLC may use their order and search history to display personalized ads for restaurants or merchants that are available on VOO LLC Eats.
  • Third-party ads: Users may choose here whether VOO LLC may use their data to display ads for third party products or services that are personalized based on users’ observed or inferred interests and characteristics.
  • Cookies and related technologies: For information on how to control VOO LLC’s use of cookies and related technologies, including for the purpose of displaying personalized ads, please see our Cookie Notice.

User Data Requests.

VOO LLC provides users with a variety of ways to learn about, control and submit questions and comments about VOO LLC’s handling of their data.

  • Accessing data: Users can access data including their profile data and trip or order history through the VOO LLC apps or via VOO LLC’s website. Users can also use our Explore Your Data feature to view an online summary of information about their account, such as number of trips or orders, rating, rewards status and number of days since they have been a VOO LLC user. Users can also request access to their data here.
  • Data portability: Users can request a copy of their data using our Download Your Data tool. For an overview of the data available through that tool, please click here. Users may also request a copy of their data here.
  • Changing or updating data: Users can edit the name, phone number, email address, payment method and photo associated with their account through the Settings menu in VOO LLC’s apps or driver portal. Users may also request to update or correct their data here.
     
  • Deleting data: Users may request deletion of their account at any time through VOO LLC’s Privacy Centre or in the Settings > Privacy menus in the VOO LLC app.
  • Objections, restrictions and complaints: Users may request that we stop using all or some of their data, or that we limit our use of their data. This includes objecting to our use of data that is based on VOO LLC’s legitimate interests. VOO LLC may continue to process data after such objection or request to the extent required or permitted by law.

In addition, depending on their location, users may have the right to file a complaint relating to VOO LLC’s handling of their data with the data protection authority in their country. For example, users in the European Union and South America may submit such requests to the data protection authorities in the country in which they live.
